These general conditions govern access to and use of this website. The conditions governing the purchase of products are set out in the terms of sale.

2. Users

Accessing and/or using this site confers the status of USER, who, from that access and/or use, accepts the general conditions of use set out here. These conditions apply regardless of any terms of sale that may be binding in each case.

3. Use of the site

This site provides access to information, services, programs or data (hereinafter, «the contents») belonging to Finca Loma Verde or its licensors to which the USER may have access. The USER assumes responsibility for the use of the site. That responsibility extends to any registration needed to access certain services or contents. When registering, the USER is responsible for providing truthful and lawful information. As a result of this registration, the USER may be given a password for which they will be responsible, undertaking to use it diligently and confidentially.

The USER undertakes to make appropriate use of the contents and services that Finca Loma Verde offers through its site and, by way of example but not limitation, not to use them to (i) engage in unlawful or illegal activities or activities contrary to good faith and public order; (ii) distribute content or propaganda that is racist, xenophobic, illegally pornographic, that condones terrorism or that infringes human rights; (iii) cause damage to the physical and logical systems of Finca Loma Verde, its suppliers or third parties, or introduce or spread on the network computer viruses or any other physical or logical systems capable of causing the damage mentioned above; (iv) attempt to access and, where applicable, use other users' email accounts and modify or manipulate their messages.

Finca Loma Verde reserves the right to remove any comments and contributions that infringe respect for personal dignity, that are discriminatory, xenophobic, racist or pornographic, that harm young people or children, public order or public safety, or that, in its judgement, are not suitable for publication. In any case, Finca Loma Verde will not be responsible for opinions expressed by users through comments or other participation tools.

4. Data protection

Finca Loma Verde complies with Regulation (EU) 2016/679, the General Data Protection Regulation, with Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights, and with any other legislation in force at any given time, and ensures the correct use and processing of the user's personal data. Next to each form that collects personal data, the user is informed of the identity of the controller, the purpose and legal basis of the processing, the recipients, the retention periods and how to exercise their rights of access, rectification, erasure, restriction, objection and portability. 5. Intellectual and industrial property

Finca Loma Verde, in its own right or as assignee, owns all intellectual and industrial property rights in its website and in the elements it contains (by way of example: images, sound, audio, video, software or texts; trade marks or logos, colour combinations, structure and design, selection of materials used, computer programs needed for its operation, access and use), owned by Finca Loma Verde or by its licensors. All rights reserved. Under articles 8 and 32.1, second paragraph, of the Intellectual Property Act, the reproduction, distribution and public communication, including making available, of all or part of the contents of this website for commercial purposes, in any medium and by any technical means, without the authorisation of Finca Loma Verde, are expressly prohibited. The USER undertakes to respect the intellectual and industrial property rights owned by Finca Loma Verde. The USER may view the elements of the site and even print, copy and store them on their computer's hard drive or on any other physical medium, provided this is solely and exclusively for their personal and private use. The USER must refrain from deleting, altering, circumventing or manipulating any protection device or security system installed on the pages of Finca Loma Verde.

6. Exclusion of warranties and liability

Finca Loma Verde is not liable, under any circumstances, for damages of any kind that may be caused by, by way of example: errors or omissions in the contents, unavailability of the site, or the transmission of viruses or malicious or harmful programs in the contents, despite having adopted all necessary technological measures to prevent this. The above is without prejudice to the liability that legally corresponds to Finca Loma Verde towards consumers for the products sold through this store.

7. Changes

Finca Loma Verde reserves the right to make, without prior notice, any changes it deems appropriate to its site, and may change, remove or add both the contents and services provided through it and the way in which they are presented or located on its site.

8. Links

Should the domain contain links or hyperlinks to other internet sites, Finca Loma Verde will not exercise any kind of control over those sites and contents. In no case will Finca Loma Verde accept any liability for the contents of any link belonging to a third-party website, nor will it guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, truthfulness, validity or constitutionality of any material or information contained in any such hyperlinks or other internet sites. Likewise, the inclusion of these external connections will not imply any kind of association, merger or participation with the connected entities.

9. Right of exclusion

Finca Loma Verde reserves the right to deny or withdraw access to the site and/or the services offered, without prior notice, on its own initiative or at the request of a third party, to users who breach these general conditions of use.

10. General

Finca Loma Verde will pursue any breach of these conditions, as well as any improper use of its site, exercising all civil and criminal actions available to it by law.

11. Amendment and duration of these conditions

Finca Loma Verde may amend the conditions set out here at any time, duly publishing them as they appear here. These conditions remain in force for as long as they are displayed and until they are amended by others that are duly published.

12. Governing law and jurisdiction

The relationship between Finca Loma Verde and the USER is governed by Spanish legislation in force. In contracts with consumers, the courts of the consumer's place of residence have jurisdiction; in all other cases, any dispute will be submitted to the courts of the city of Cádiz.
